Terms of Use

Effective October 10, 2026

These terms are an agreement between you and Redstone Oak Investments LLC, a Texas limited liability company ("we", "us"), for the Mile Marker app and this website. By using either, you agree to them.

1. Safety first

In an emergency, call 911. Mile Marker does not contact emergency services or anyone else for you.

Don't handle your phone while driving. Set up the app before you drive, use a mount, or let a passenger use it. Follow Texas law and all traffic laws, and keep your attention on the road.

2. Readings are estimates

Mile Marker estimates your position from your phone's GPS and road data from the Texas Department of Transportation. Tenths of a mile are calculated between posted signs. GPS can be off, signs can be moved or missing, and road data can be out of date or wrong. Always check against the posted signs and your surroundings.

Do not rely on the app as your only way to find or report a location, and do not use it for surveying, property lines or legal descriptions.

3. Directions

Directions come from Apple Maps and need cell service. Routes can be wrong, incomplete or unsafe, and they may not reflect closures, construction, weather or private property. Use your own judgment and obey posted signs.

3a. Groups and location sharing

Share your location only with people you trust, and only share a group code with people who agree to be in that group. Never use Mile Marker to follow, monitor or locate anyone without their knowledge and consent. Doing so may be a crime, and it ends your right to use the app.

Shared positions can be delayed, wrong or missing, for example when a phone has no signal. Do not rely on group locations for anyone's safety. You are responsible for the names, pins and descriptions you share. Don't share anything unlawful, private to someone else, or abusive.

4. Price and refunds

Mile Marker is free. It has no in-app purchases or subscriptions, so there is nothing to refund. If that ever changes, Apple handles all payments and refund requests go through Apple at reportaproblem.apple.com.

5. License

We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use. You may not copy, extract or resell the app's road and mile marker data, reverse engineer the app, or use it to break the law.

6. Third-party data and services

Road, mile marker and county line data come from the Texas Department of Transportation. Maps and directions come from Apple. We do not control them and are not responsible for their accuracy or availability. Mile Marker is not affiliated with or endorsed by TxDOT, Apple, or any government agency.

7. No warranty

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE APP WILL BE ACCURATE, AVAILABLE OR FREE OF ERRORS.

8. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS, INJURY OR DELAY ARISING FROM YOUR USE OF OR RELIANCE ON THE APP, INCLUDING A WRONG OR DELAYED LOCATION OR ROUTE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE APP OR $10. Some places do not allow these limits, so they may not all apply to you.

9. Indemnity

You agree to defend and hold us harmless from claims arising from your misuse of the app or your breach of these terms.

10. Apple

If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be heard in the state or federal courts located in Texas.

12. Changes

We may update these terms. We will post the new version here with a new effective date. Using the app after that means you accept the change.
